Special Needs Trust

A Special Needs Trust (SNT) is established to manage resources while maintaining an individuals eligibility for public assistance benefits. They allow a beneficiary to receive gifts, lawsuit settlements, or other funds so that such funds will not be considered to belong to the beneficiary in determining eligibility for government programs. These trusts are not meant to provide for basic support, but rather to provide for comforts and luxuries beyond those provided by public assistance. Some of the things that these trust can provide for include education, recreation, counseling and medical attention. A SNT must be established by a parent, grandparent or court solely for the benefit of a disabled person under the age of 65. Because of complexity in regards to eligibility for public assistance these trusts should only be drafted by an attorney with experience and knowledge of Special Needs Trusts.
